POPIA & Privacy Policy
1. Who is responsible for your information

3. What personal information we collect
Depending on your relationship with us, we may collect: your full name, identity number, date of birth and gender; contact details (address, email, telephone); banking details and bank-statement data; employment and income information; affordability and expense information; credit history and credit-bureau data; information required to provide credit life insurance; device, IP address and usage data when you use our website; and records of your communications with us.
4. How we collect your information
We collect information directly from you when you apply for a loan, use our website or contact us; from third parties such as credit bureaux, bank-statement verification providers and your bank (where you authorise this); and automatically through cookies and similar technologies when you use our website.
5. Why we process your information and our lawful basis
We process your personal information to: assess your loan application and conduct the affordability assessment required by the National Credit Act; verify your identity and prevent fraud; enter into and administer your loan agreement; arrange credit life insurance; collect repayments; report to and query credit bureaux; comply with legal and regulatory obligations (including the NCA, the Financial Intelligence Centre Act and tax law); and improve our website and services. We rely on one or more of the following lawful bases under POPIA: your consent, the performance of a contract with you, compliance with a legal obligation, and our legitimate interests.
6. Special personal information
We do not seek special personal information unless it is necessary and permitted by law. Where credit life insurance requires health-related information, it will be processed only with your consent and in accordance with POPIA and the insurer's requirements.
7. Who we share your information with
We may share your personal information with: registered credit bureaux; the insurer and administrator providing your credit life cover; payment and DebiCheck/debit-order processors and your bank; identity, fraud-prevention and bank-statement verification providers; our professional advisers and IT service providers who process information on our behalf under written agreements; and regulators, courts or law-enforcement authorities where required by law. We require all operators (service providers) to keep your information secure and to process it only on our instructions.
8. Cross-border transfers
Where any service provider processes or stores information outside South Africa, we will ensure that the transfer complies with section 72 of POPIA, including that the recipient is subject to laws or agreements providing an adequate level of protection.
9. How we protect your information
We take appropriate, reasonable technical and organisational measures to secure your personal information against loss, damage and unauthorised access, in line with section 19 of POPIA. These include access controls, encryption in transit, secure hosting and staff confidentiality obligations. If a security compromise affecting your information occurs, we will notify you and the Information Regulator as required by law.
10. How long we keep your information
We retain your personal information only for as long as necessary to fulfil the purposes described in this Policy, or for longer where the law requires (for example, records that must be kept under the NCA, the Financial Intelligence Centre Act and tax legislation). When information is no longer required, we securely delete or de-identify it.
11. Your rights as a data subject
Under POPIA you have the right to: be notified that we are collecting your information; request access to the personal information we hold about you; request that we correct or delete information that is inaccurate, irrelevant, excessive or out of date; object to the processing of your information on reasonable grounds; withdraw consent where processing is based on consent (subject to legal or contractual restrictions); and lodge a complaint with the Information Regulator. To exercise any of these rights, contact our Information Officer using the details above. You may be asked to complete the prescribed POPIA forms.
12. Direct marketing
We will only send you direct marketing by electronic communication where you have consented or where permitted by law, and every marketing message will give you the option to opt out. You can tell us at any time that you do not wish to receive marketing.
13. Cookies
Our website uses cookies and similar technologies to make the site work, remember your preferences and understand how the site is used. You can control cookies through your browser settings; disabling some cookies may affect how the website functions.
14. Credit bureaux
By applying for credit, you acknowledge that we will share information about your application, your loan and your payment behaviour with registered credit bureaux, and that we will obtain information from them, in accordance with the National Credit Act.
15. Changes to this Policy
We may update this Policy from time to time. The current version is always available on this website, and the "Last updated" date shows when it last changed.
